Steven Buck Lawn Maintenance LLC requests two temporary seasonal Winter Property Maintenance Workers from December 1, 2026, through February 28, 2027. The Employers need is seasonal because it is tied to its recurring annual winter property-maintenance season and the increased workload created by winter weather conditions. The requested workers will not be needed from March 1 through November 30. During the requested period, the Employer provides manual snow removal, shoveling, salting, calcium application, de-icing, and related winter property-maintenance services using hand tools at approximately 60 customer locations in Wellsburg and surrounding communities. Local climate data corroborate the seasonal timing of this work. Wellsburgs average snowfall, measured over a rolling 31-day period, increases from approximately 1.1 inches on December 1 to approximately 2.4 inches on January 1, reaches a winter peak of approximately 3.1 inches around February 13, and remains approximately 2.8 inches on February 28. Winter in Wellsburg falls entirely outside the local growing season. These recurring conditions substantially overlap the requested employment period and create a predictable need for manual snow removal, ice control, and related winter property maintenance. (WeatherSpark) The Employer conducts its winter-maintenance business through established verbal service agreements rather than written customer contracts. Under these arrangements, customers authorize the Employer to provide recurring manual snow and ice removal services at their properties during the winter season. The attached Schedule of Work was prepared from the Employers active customer accounts and identifies each customer or project, service address, authorized winter services, requested period, and estimated labor hours. It documents approximately 60 bona fide customer locations and 1,208 hours of winter work scheduled from December 1, 2026, through February 28, 2027. This equals approximately 92.9 labor hours per week. Dividing the weekly labor requirement by the expected 40-hour workweek results in a need for approximately 2.3 full-time workers, or approximately 2 workers. Accordingly, the request for two temporary workers is a reasonable and conservative estimate of the additional workforce needed to perform the identified winter work. The Employers need for the two requested workers ends on February 28, 2027, when the winter service period and need for the additional workforce conclude. Accordingly, its need for two Winter Property Maintenance Workers is temporary and seasonal because it is confined to a defined and predictable winter period, recurs in connection with an annual winter weather pattern, and does not continue during the remainder of the year.
