Work description
The Household has a one-time occurrence need for one (1) Nanny from November 14, 2026, to November 13, 2029. To establish a one occurrence, need, the law requires a petitioner to show ONE of the following to establish a temporary need based on a one-time occurrence: (i)The petitioner has not employed workers to perform the services or labor in the past, and the petitioner will not need workers to perform this in the future; OR (ii) The petitioner has an employment situation that is otherwise permanent, but a temporary event of short duration has created a need for temporary workers. Please note that the households onetime occurrence need is based on the first prong of the standard (The petitioner has not employed workers to perform the services or labor in the past, and the petitioner will not need workers to perform this in the future). The regulation is disjunctive (OR, not AND), so this petition relies solely on the first prong and does not seek to establish that a temporary event created a need within an otherwise permanent employment situation under the second prong. Specifically, the nature of the job opportunity and the employment of a single nanny demonstrate that the households need is temporary and related to a specific increase in childcare demands, rather than an ongoing household staffing requirement. In fact, the household currently has a two-year-old child, and the second child was born in April 2026, (See Exhibit B- Children Birth Certificates) creating a temporary period of increased childcare needs associated with the transition to caring for two young children simultaneously. The requested nanny position is intended to provide supplemental childcare support during this limited period of heightened need. The position is limited to one full-time temporary childcare worker and is not part of a broader household staffing structure or an ongoing need for multiple domestic employees. The household has never previously employed a full-time nanny to perform the services and labor for which certification is now sought. In fact, the households prior childcare arrangement involved a J-1 cultural-exchange au pair, which was fundamentally different from the full-time nanny position requested here, as explained herein. The J-1 arrangement was temporary, governed by the requirements of the cultural-exchange program, and does not establish an ongoing full-time nanny position within the household. By contrast, the requested H-2B position is a full-time, temporary childcare position specifically established to address the familys temporary need for expanded childcare following the birth of their second child. The H-2B worker will provide consistent and comprehensive childcare coverage based on the familys current circumstances and the parents demanding schedules. Accordingly, although both arrangements involve childcare, the nature, purpose, structure, and scope of the two positions are materially different. Equally important, the household will not need a full-time nanny in the future. The present need is limited to the period during which the familys two children require the additional level of care described herein. Once this period concludes, the parents will resume regular family care arrangements.
