Smuggs Operations Company LLC d/b/a Smugglers Notch Resort (the Petitioner) has a seasonal need for workers in this temporary position. The Petitioner is a high-end resort and ski destination located in Jeffersonville, Vermont. Although Smugglers Notch Resort also has a short summer peak season due to warm-weather recreation, the Petitioner is more well-known for its winter snowsports activities from December through March. Due to the drop in business activity that occurs from April through November, the Petitioner significantly scales back operations and therefore, has no need to employ workers in the Lift Attendant position during the off-season months. Therefore, the services offered by the Petitioner are seasonal in nature. Please see the enclosed letter entitled "Statement of Temporary Need" and enclosed supporting documents for further detail. Located in the rural mountain town of Jeffersonville, the hiring potential of the Petitioner is very limited. The bulk of the areas residents tend to be seasonal tourists, and there are very few permanent occupants who have inclinations of entering the local workforce. Additionally, the Petitioner is in constant competition with every other local business for the same, limited U.S. workforce. Due to these factors, the Petitioner consistently struggles to find local workers who are willing and able to fill this temporary position.
