- Employer makes all payroll deductions required by law. Employer doesn’t envision other workforce-wide payroll deductions. If requested employer helps non-local workers secure optional worker-paid lodge. Employer deducts reasonable fair market value cost of rent/utilities based on # of occupants electing to reside in employer-arranged housing (cost TBD). Voluntary advances/loans made to workers, if any, may be repaid by pre-authorized payroll deductions. Employer may deduct health insurance premiums for workers voluntarily participating in plan. Uniform provided at no cost. Employer may deduct cost for lost/damaged uniforms resulting from worker negligence, or voluntary purchase of additional uniforms for worker's benefit. Employer offers PTO accruals based on years of service. Employer provides incidental transportation between worksites as necessary. Employer offers free daily transportation to/from worksite from designated pick-up location. Use of transportation is voluntary.

Work description
H&M Snow Pros, Inc (established in 2000) is an employer engaged in property maintenance services. We have a temporary, seasonal need for 48 workers to be employed as Snow Shovelers (SOC 37-3011.00 Landscaping and Groundskeeping Workers). We are a returning H-2B program user, and the instant request is substantially consistent with our previously established temporary need. We are requesting a slightly earlier start date, as well as a slightly later end date. Both of these changes combined are less than a 30 day difference compared to our most recent application, as certified under ETA Case # H-400-25259-311522. These minor changes are needed to better meet our customers winter needs. The changes are immaterial in nature, and directly correspond to historical weather data for our area (near Cleveland, OH). II. Regulatory Standards Per the regulations, a seasonal labor need is one in which the employers need for services or labor is traditionally tied to a season of the year by an event or pattern and is of a recurring nature. Employment is not considered seasonal if the period during which the services or labor is not needed is unpredictable or subject to change, or is considered a vacation period for the employers permanent employees. The request for seasonal workers must also represent bona fide job opportunities for the number of workers requested. III. Temporary Need A. Period of Need H&M Snow Pros, Inc seeks to employ Winter Services Technicians from December 1, 2026, through March 5, 2027. This seasonal labor need is driven by predictable, annually recurring winter weather conditions and an associated surge in customer demand for snow and winter property maintenance services. In Newbury township, OH (near Cleveland, OH) and the surrounding counties where we operate, winter begins in earnest by early December, bringing below-freezing temperatures, frost, and early snow. These conditions persist through March and necessitate winter-specific property maintenance, including snow and ice removal, winter storm cleanup, winter pruning, and equipment servicing. According to historical weather data, average high temperatures drop into the 30s (Fahrenheit) by December, with regular snowfall and ice storms peaking in December through March. This need for seasonal workers ends in March when business activities diminish due to the onset of warmer weather and the corresponding decline in customer demand. The need for labor during this period is not a vacation period for our permanent employees. Instead, it marks the busiest season for our winter operations. Our services are in high demand when snow begins to accumulate and ice storms make residential and commercial properties hazardous. The recurring nature of this work, dictated by annual climatic patterns, satisfies the definition of a seasonal need under 20 CFR 655.5. B. Bona Fide Job Opportunity Based on our historical performance and projected demand for the 2026-2027 winter season, H&M Snow Pros, Inc has established a bona fide business need for 48 Winter Services Technicians. This is consistent with our most recent H-2B application. The 48 requested Winter Services Technicians are essential to sustaining timely, high-quality service across our broad client base while managing multiple concurrent dispatch routes during snow events. Winter services require rapid deployment to client sites, often during hazardous weather conditions, to mitigate liability risks and ensure accessibility. This physically demanding work must be performed promptly after snowfall or ice accumulation and cannot be postponed or scaled back without breaching service expectations or jeopardizing client safety. The combination of high service volume, strict timelines, and physically intensive work underscores the necessity of a dedicated seasonal workforce at the requested staffing level.
