DETAILED STATEMENT OF TEMPORARY NEED 2026-2027 Dates of Need for H-2B Construction Laborer will be 12/01/2026 to 04/15/2027. Gateway Construction Services, Inc. is a St. Louis, Missouri contractor with two lines of work. We are an asbestos, lead, mold and hazardous waste abatement contractor, and we are a construction contractor performing structural repair, building stabilization, storm and tornado damage restoration, demolition and the rehabilitation of residential and commercial buildings. We operate year-round. Our abatement work is concentrated in the spring, summer and fall, the construction work on the buildings we abate follows it and peaks in the winter months, and the temporary workers requested in this petition are needed for our construction operations. Our date of need for temporary workers is the regularly recurring annual cycle of our business, in which our construction workload peaks from December through the middle of April. I. Temporary Need To assist in the determination of whether our company's need is consistent with the USCIS definition of temporary need, we are including the following information: Work Duties will be consistent with those stated on the USDOL ETA Form 9142B and the USCIS I-129 Petition for Nonimmigrant Worker. These duties are evidenced in the signed contract and accepted bids we have in place for the 2026-2027 season. Duties the requested workers would be performing are consistent with those described in the US Department of Labor ETA Form 9141 Prevailing Wage Determination for Construction Laborers, SOC 47-2061, PWD Case Number P-400-26157-988923, at the determined wage of $32.06 per hour. Based on the careful analysis described later in this document, our need for 3 temporary H-2B workers is fully supported by our company's workload for the 2026-2027 construction season, and our workload analysis substantiates the need for the requested workers throughout the entire period of proposed employment, i.e., at the stated hourly wage and number of hours each week. Our temporary need is a peak load need. II. Operations We operate year-round working at customer jobsites throughout the City of St. Louis, St. Louis County and the surrounding counties in Missouri and Illinois. Our two lines of work are the abatement of asbestos, lead, mold and hazardous waste, and construction: structural repair, building stabilization, storm and tornado damage restoration, demolition, and the rehabilitation of damaged and deteriorated buildings. We regularly employ two permanent Construction Laborers throughout the year. Most of our abatement work is performed in the spring, summer and fall, and abatement comes first. We perform that work in the warmer months because of what it requires. Abatement has to be carried out under heavy ventilation with a constant supply of fresh air, the material and the work area must be kept wet while the material is removed, and much of the work is done outside the building or with the building opened up. Those conditions can be maintained in the spring, summer and fall. They cannot be maintained in freezing weather, and that is why the bulk of it falls in the warmer months. We continue to perform abatement work through the winter, but at a much reduced level. Asbestos, lead, mold and other hazardous materials must be removed from a building, and the building cleared, before structural repair, demolition or rehabilitation work can disturb it. The construction work on a building therefore cannot begin until its abatement is finished. Every building we abate over the spring, summer and fall joins our construction queue as soon as it is cleared. By late fall a full season of cleared buildings is waiting on construction work. That is why our construction season opens in October and builds to its peak in December, when the backlog of cleared buildings waiting on us is at its largest and the great majority of our people are working on construction.
